Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ankhora Inc. ("Ankhora," "we," "us," or "our"). They govern your access to and use of the Ankhora tracker device, the Ankhora mobile application ("App"), our web dashboard, subscription plans, and all associated services (collectively, the "Services").
By creating an account, activating a device, downloading the App, or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Description of Service
Ankhora provides a hybrid Bluetooth and GPS tracking solution designed to help users locate personal items such as wallets, bags, and travel documents. Our Services include:
- Hardware: The Ankhora card-sized tracking device with BLE and optional GPS/LTE capabilities.
- Mobile App: iOS and Android application for pairing, locating, and managing your Ankhora device.
- Basic Tier (Free): Bluetooth proximity tracking, nearby alerts, and last known location.
- Premium Tier (Subscription): Real-time GPS tracking, LTE connectivity, cellular location updates, and advanced alerts.
- Web Dashboard: Online portal for managing device settings and viewing location history.
Eligibility
You must be at least 18 years of age to create an account and use the Services. By using Ankhora, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
Accounts & Registration
To access the full features of the Ankhora Services, you must create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Keep your password confidential and not share account access with others.
- Notify us immediately at support@ankhora.co if you suspect unauthorized access to your account.
You are solely responsible for all activity that occurs under your account.
Hardware & Device
Upon purchase, Ankhora transfers title of the hardware device to you. The following terms apply to your device:
Ankhora reserves the right to push firmware updates to your device to improve performance, security, or compliance. These updates may be applied automatically.
Subscriptions & Billing
The Ankhora Premium Plan enables GPS and LTE-based tracking features and is offered on a recurring subscription basis.
- Billing Cycle: Subscriptions are billed monthly or annually, as selected at checkout.
- Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation: You may cancel your subscription at any time through your account settings. GPS and LTE features will remain active until the end of the paid period.
- Price Changes: We may change subscription prices with at least 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new price.
- Free Tier: Basic BLE tracking features remain available without charge following cancellation of a premium subscription.
Prohibited Uses
You agree not to use the Ankhora Services to:
- Track, surveil, or monitor any individual without their explicit knowledge and consent.
- Engage in stalking, harassment, or any activity that violates applicable laws.
- Place a device in another person's belongings without their consent.
- Circumvent or tamper with any anti-stalking or safety features built into the device or App.
- Interfere with or disrupt the integrity or performance of the Services or related infrastructure.
- Use the Services for any unlawful purpose or in violation of any local, national, or international law or regulation.
- Collect, store, or use location data of other individuals without proper legal authority to do so.
Violation of these restrictions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.
Intellectual Property
All software, designs, trademarks, logos, and content associated with the Ankhora Services are the exclusive property of Ankhora Inc. or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App and Services solely for your personal, non-commercial use in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works from any Ankhora content without our express written consent.
Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal information, including location data. Please review it carefully.
Disclaimers
THE ANKHORA SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Ankhora does not warrant that:
- The Services will be uninterrupted, error-free, or free of viruses or other harmful components.
- GPS or cellular coverage will be available in all locations or at all times.
- Location data will be perfectly accurate in all circumstances (e.g., indoors, in tunnels, or in areas with poor satellite visibility).
- The device will prevent loss, theft, or recovery of any item in every situation.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANKHORA INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR LOSS OF PERSONAL PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
IN NO EVENT SHALL ANKHORA'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR ANKHORA PRODUCTS AND SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify, defend, and hold harmless Ankhora Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Termination
Ankhora reserves the right to suspend or terminate your account and access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the interests of Ankhora.
You may terminate your account at any time by contacting us at support@ankhora.co. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.
Changes to Terms
Ankhora reserves the right to modify these Terms at any time. We will notify you of material changes by email or through an in-app notification at least 14 days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
